Terms and Conditions of Participation in SkateFresh 2021 (“Event”)

Participation in the Event is subject to and conditional upon the following terms and conditions. These terms and conditions document consist of two parts:

Part A, containing general terms and conditions

Part B, containing a Participant declaration, which is to be signed upon the start of the Event as well.

 

Definitions:

"Organizer" means "Stichting Skate Fresh" (Skate Fresh foundation) also abbreviated as "Skate Fresh", "SkateFresh" or "Skate-Fresh" .

 

"Event" means the inline skating tour starting the afternoon before Ascension Day at 16:00 and ending the first Sunday following Ascension Day at 18:00.

 

"Skate Fresh Refreshed" refers to Event.

 

"Registrant" means any person who's name and personal details has been submitted through the registration form on the Event’s web site.

 

"Participant" means the person who registered and paid the participation fee in order to participate in the Event and received a confirmation from Organizer by email. All persons registered by and/or paid for by a Participant, will individually be considered as a Participant.

 

"Agreement" means the confirmed participation of Participant in the Event by Organizer in compliance with these Terms and Conditions of Organizer.

 

Part A: General Terms and Condition of the Event "Skate Fresh"

Registration, Invoice and Payment

After registration the Registrant will receive an automatically generated confirmation email of his/her registration showing the details which have been submitted through the registration form.

This confirmation email doesn’t count as a guarantee of participation.

In case that the number of Registrants is higher than the capacity of the Event, a selection procedure will be held. The selection procedure will take into account the nature of the Event, being a get together of a balanced mix of Participants of various countries and thus set a limit on overrepresented Registrants of the same country of origin in the total of all Registrants.

Organizer reserves the right to refuse a Registrant to become a Participant due to misbehavior in prior editions of the Event, ill health, insufficient level of inline skating skills known to Organizer, or any other reason at the discretion of Organizer.

Selected Registrant will become a Participant in the Event after receipt of an invoice, issued by the organization and payment of that invoice.

The Organizer reserves the right to cancel the Agreement with immediate effect in case the number of registrations is smaller than the minimum number of registrations required for organizing a break-even Event.

The Participant shall provide the organizer his/her personal details and his/her fellow-Participant(s). The Participant will inform Organizer if any changes occur.

 Chargeable amounts

The published participation fee of the Event is per Participant and based on the prices as known to the organizer when the information on internet was made active.

 

Payment

The chargeable amounts (participation fee) must be at Organizer's disposal within the period as stated on the invoice issued by the Organizer. Upon reception of payment by Organizer, Registrant will be considered as a Participant.

If the chargeable amount is not received in time, Organizer will notify Registrant via
e-mail. If the chargeable amount is not received within 5 days after sending the e-mail, the registration is presumed to be not valid.

 

Cancelation (by Participant)

Because SkateFresh is a non-profit organized skate event and costs have been calculated on the number of Participants there will be no restitution of funds in case of cancellation by the participant. See “Replacement” below.

Replacement

Before the start of the event, Participant can transfer his or her participation to a substitute Participant (= another skater). The original Participant and the substitute Participant are jointly and individually liable with respect to the Organizer for payment of the outstanding part of the invoice total, if applicable. Substitute may change accommodation, if sufficient available.

 

Health declaration

The organizer reserves the right to remove any Participant from the Event during the Event due to ill health, or any other reason (at the Organizer’s discretion) that may render him/her unfit to safely complete the Event.

The Participant confirms that he/she will not take part in the Event if he/she is suffering from any injury,  illness or disease which may impair his/her performance, or which might harm other Participant’s or Organizer’s health and confirms that he/she will report any illness and/or disease during the Event to Organizer immediately. In such case Participant is held to leave the Event.

No refunds will be made by Organizer in case Organizer refuses or rejects participation. Participant will have to turn to his or her insurance company.

 

Participant obligations

Participant agrees to abide by all Event rules, regulations and instructions issued by or on behalf of Organizer and any road regulations serving to ensure the smooth fulfillment of the Event and is liable for any damages caused by any unlawful behavior.

Participant is responsible for damage which the Organizer, their employees/volunteers by Participant’s error incur.

Participant is obligated to avoid or limit damages as much as possible.

 

Cancelation (by Organizer)

Organizer reserves the right to cancel the event due to severe change of circumstances beyond the reasonable control of Organizer. In case of a cancellation by Organizer, an alternative proposal will be made by Organizer, if possible.
If this is not possible the Organizer will partially refund the participation fee, paid by Participant. Organizer is a non-profit organization run by volunteers with limited financial resources. In case of cancelation of the Event due to severe change of circumstances, Organizer will already have spent part of the participation fee to third party suppliers. In case of cancellation, Organizer will do it's best to limit expenses as much as possible in order to be able to refund a reasonable part of the participation fee to Participant.

"Severe change of circumstances" will include, but are not limited to, circumstances where actual participation in the Event will, or might, harm Participant’s and or Organizer’s health, a conflict of the Event with governmental or local regulations arises, not publicly known at the opening of registration of the Event, bankruptcy of third party suppliers where Organizer already made substantial down payments, unforeseen unavailability of the accommodation of the Event, environmental conditions which make it impossible for Event to take place, war, terrorism, government rulings, etc. (“Force Majeure”). (Normal rainy conditions for Holland will not be considered as "severe circumstance", during the Event daily skate tours will take place as long as it will be safe enough to do so).

In the event of cancellation of the Event or a Participant’s entry for any reason, Organizer will have no responsibility for or expenses incurred by Participant as a result of cancellation, including any travelling or accommodation expenses, except for the (partial) registration fee as mentioned above.

The Organizer reserves the right to cancel the Event for any reason, but where such a reason is not attributable to Force Majeure, the Participant will be entitled to a refund of their participation fee (excluding administration fees).

Changes by Organizer

Organizer has the right to modify services of the Event on one or more substantial points due to important circumstances unforeseen and beyond control of Organizer.

 

NON-responsibilities of Organizer

Organizer cannot be held responsible for any damage against Participant for which the Participant has insured himself or chosen not to insure himself (for example travel insurance, health insurance and others)

Organizer cannot be held responsible for any missing connections/not arriving at the place of destination.

Organizer cannot be held responsible for failures of other third party service providers, nor for the correctness of information supplied by this other third party service provider.

Organizer cannot be held responsible for possible promises of its employees and/or third parties.

Above mentioned non-responsibilities also apply for the Organizer’s staff and/or volunteers.

 

Documents

The Participant must ensure that he or she has the possession of the required documents (passport, identity card), the visas (if applicable).
The Participant will inform him/herself at the authorities concerned if previous obtained information concerning the documents and visa’s is still valid.

All relevant communication concerning the Event will be published through the following channels:

The Participant  himself/herself is said to be responsible for taking note of any communications published by Organizer.

Organizer will inform participants in time of any relevant details concerning the event.

These Terms and conditions are governed by Dutch law and the Dutch Courts shall have exclusive jurisdiction in relation hereto.

PART B: Participants Declaration of SkateFresh

 

Organizer will provide a declaration which is to be signed by each individual upon arrival at the event. This declaration will contain the information as follows:

Participant:

  1. is fully aware that participating in this Event is a potentially risky and dangerous activity, which can cause serious injury and even death.
  2. will not participate in this Event and will not inline (speed) skate unless he is medically fit and physically in (good) condition. In case of physical or medical impairment which will complicate the practice of the sport the participant will notify the Organization immediately.
  3. is aware that on the route there will be vehicles and other road users and that during the Event he/she will have the status of a normal road user. In the Netherlands, skaters have the same status as pedestrians.
  4. will accept all risks and consequences joined to inline (speed) skating this tour including contact with other Participants, the risks joined to collision and falling, the effect of weather conditions and the conditions of the roads.
  5. is responsible for his own material and luggage during the event.
  6. will not put responsibility with the Organization for loss, theft or damage suffered before, during or after the tour.
  7. will have to declare himself, his heirs, executors, or anyone else who would place a claim on his behalf, to waive prosecution by fault, to not claim compensation and to guard the members of the SkateFresh Organisation and all those connected to the organization of the tour against any and all claims of responsibility for death, injury and personal or material damage of any kind be it foreseen, unforeseen, known or unknown.
  8. is obliged to wear a CE quality helmet during all skate activities during the full duration of the tour. Participant is recommended in wearing sufficient body protection as well.
  9. will have read and agreed to the in part B mentioned declaration.
